Illinois Medicaid Death Benefits

The Illinois Public Aid Code specifies in the Illinois Compiled Statute 305 ILCS 5/3-8 states that if the estate of a deceased Medicaid recipient is insufficient to pay for funeral expenses then the Illinois Department of Human Services will provide the funds necessary to meet the costs of a funeral and burial. - The IDHS will provide payments for funeral and burial expenses for the deceased only if he was receiving public assistance at the time of his death. This includes Medicaid, Temporary Assistance for Needy Families Cash, Aid to the Aged, Blind or Disabled, or Family Assist.
Family members or those with legal responsibility for the deceased are not eligible for reimbursement. Individuals with no family or legal relation can apply for reimbursement if they have paid or donated funds for internment below $2,000.
- The IDHS pays only for basic funeral and burial expenses with a maximum amount of $1,103 for the funeral home and $552 for the cemetery burial. Relatives who have claim to the estate and are legally responsible for the deceased cannot claim reimbursement. Any additional expenses above the maximum amounts accrued for the funeral are not reimbursable.
- The IDHS pays for funerals. Completing a Vendor Claim Form is one way to claim reimbursement. Illinois Funeral and Burial Claim Form IL 444-0029 is submitted by the funeral home or cemetery. IDHS also limits additional expenses that may be contributed for the cost of the casket, urn or vault to $2,000 funeral and $2,000 burial.
Deceased individuals who were in a hospice program should have applied and determined eligibility through their Hospice service on the day of admission. Families should contact the Hospice for Medicaid burial benefits information.
Another way to claim Medicaid burial benefits is by submitting a Funeral and Burial Reimbursement Claim IL444-0094. Family members and individuals legally responsible for the deceased are not qualified to apply. Persons who are not legally responsible for the deceased but pay for internment are eligible to file.
- Forms are available for pick up at any local Illinois Family Community Resource Center or online through the IDHS. Illinois burial reimbursement forms need to be filled out completely. Make sure to send all of the documentation requested on the form. To submit the funeral/burial reimbursement claim send the application form and all corresponding documentation to the IDHS, Funeral and Burial Unit in Springfield.
